Canada extends the policy to let visitors apply for work permits if they have valid job offers

Visitors in Canada can continue to apply for work permits in Canada while in the country, with the Trudeau government extending the temporary policy by 2 years.

The COVID-era temporary policy, which was scheduled to end at the end of February, has been extended by two years, to February 28, 2025.

According to Immigration, Refugees, and Citizenship Canada (IRCC), “leaving this temporary policy in place makes visitors an option for employers in Canada, as many are facing significant labor shortages during this period of economic expansion.”

Canada’s unemployment rate was 5% in January. According to statistics from Statistics Canada from December 2022, there were 848,000 open positions, down from over one million earlier in the year.

Since September, the nation has added 326,000 jobs, bringing the total number of employed Canadians to over 20 million for the first time.

To be eligible to apply, an applicant looking to benefit from this temporary public policy must

  • on the day they submit their application, have valid visitor status in Canada.
  • have an employment offer that is backed up by a labor market impact assessment (LMIA) or an employment offer that is exempt from an LMIA.
  • submit a request for an employer-specific work permit by February 28, 2025, at the latest.

Generally, a valid offer is for a job that is:

  • permanent and non-seasonal
  • at least for a year.
  • in a skilled occupation that falls into one of the TEER Categories 0, 1, 2, or 3 of the 2021 National Occupational Classification.

A job offer must be in writing and include specifics about the position, such as:

  • your deductions and pay.
  • your duties as a job.

A Labour Market Impact Assessment (LMIA) is usually required to back up a valid job offer. One must be requested by the employer through Employment and Social Development Canada or Service Canada.
